Can an LLC file a tax extension but still file a personal tax return?
An LLC can file a tax extension for its business tax return, but this does not extend the time to file a personal tax return for the individual members of the LLC. Each member of the LLC must file their personal tax return by the original due date, even if the LLC has filed a tax extension for its business tax return.
It’s important to note that the LLC’s tax extension only applies to the LLC’s business tax return, not to the personal tax returns of the members. Each member is responsible for filing their own personal tax return on time, regardless of whether the LLC has filed a tax extension.
If a member of the LLC is unable to file their personal tax return by the original due date, they can file a personal tax extension using Form 4868, Application for Automatic Extension of Time To File U.S. Individual Income Tax Return. This form can be filed electronically or by mail.
It’s worth noting that the rules for filing tax extensions may vary depending on the jurisdiction. LLCs and their members should consult with their tax advisors and local tax authorities for more information about the rules for filing tax extensions in their specific jurisdiction.
